Whether you are a photographer, videographer, designer, or editor, Coated Lens provides a space to showcase your work, collaborate with others, and connect with clients seeking your expertise. By using our platform, you are agreeing to the following terms and conditions. Please read them carefully before proceeding. 

II. Acceptance of terms 

Thank you for choosing Coated Lens. These Terms of Service ("Terms") outline your legal rights and responsibilities when using the Coated Lens website www.coatedlens.com and mobile applications ("Coated Lens LLP App"). By using our services, you agree to these Terms, which apply to all current and future users. Any actions taken without adhering to these Terms are at your own risk. 

Your use of the Coated Lens Platform signifies your understanding, agreement, and acceptance of these Terms. This agreement constitutes a legally binding contract between you and Coated Lens. 

III. Eligibility to use the services 

1. You must be at least eighteen (18) years old and fully capable of understanding and agreeing to the terms and conditions outlined in these Terms. 
2. To register as a user of the Coated Lens Website or any of the Coated Lens platforms, you are required to adhere to all the laws and regulations of your country while using the services. When using the services, you commit to complying with these Terms and relevant laws, making sure that your usage does not violate our legal rights or the rights of any third party. 

IV. Changes to the terms

Coated Lens reserves the right to modify or update these Terms at its discretion. It is your responsibility to review these Terms periodically to ensure ongoing compliance. Your continued use of the Coated Lens Platform after any such amendment or modification to the Terms will be considered as your explicit acceptance of the revised terms, and you agree to be bound by such modified Terms. 

V. Provision of Services by Coated Lens 

1. Coated Lens continually evolves to enhance user experience and services. You acknowledge that changes to the services may occur, including modifications, suspension, or discontinuation of services without prior notice. The platform may automatically check for and install updates, which you agree to allow. Some updates may be necessary to continue accessing our services. 
2. If your account is disabled, you may lose access to our services and any content within your account. Content on the Coated Lens website and platform is for informational purposes only, and we disclaim any liability for outdated information. We reserve the right to make changes to content without notice. Coated Lens does not guarantee service quality, listed prices, or service availability. All images and content are owned or licensed by Coated Lens, and reproduction is prohibited without permission. 
3. If you believe your copyright has been violated, contact us at accounts@coatedlens.com or contact our support team at support@coatedlens.com with the relevant details. 
4. Coated Lens reserves the right to charge fees for any product, service, or aspect of the platform, with prior notice. Referral and incentive programs may be introduced, governed by their terms and conditions. We may suspend or terminate accounts for program rule violations, fraudulent activities, or unlawful behavior. Coated Lens can modify or cancel programs without notice. 

VI. Use of Services by Users 

• Account Access 

1. To access certain features on Coated Lens, you must create a portfolio account. Your personal information is protected by our Privacy Policy, and you are responsible for keeping your password and account secure. If you register via social media, you authorize us to collect relevant information based on your account settings. 
2. All information you provide must be accurate and up to date. False claims of account ownership may result in liability for any damages. You are responsible for all account activity and must notify us of any unauthorized use. Third-party use of your account is not allowed, and you will be liable for any unauthorized access. 
3. By creating an account, you agree to receive communications from Coated Lens and its affiliates. You can manage your communication preferences in your account settings. 

You agree to use the Coated Lens platform only for lawful and permitted purposes. All data on the platform is for personal use unless otherwise authorized in writing. You must access services only through the provided interfaces and follow all instructions. Automated access methods are prohibited. 

VII. Content Guidelines 

a. Ownership of Coated Lens Content and Proprietary Rights 

1. Coated Lens and its platforms exclusively own all copyrights, trademarks, service marks, logos, trade names, trade dress, and other intellectual property rights (IP Rights) related to the Coated Lens platform and its content. These rights are protected by copyright, patent, trademark, and other applicable intellectual property laws. The content on the platform is original, created through the significant effort and investment of Coated Lens and its contributors, and is considered valuable intellectual property. 
2. You acknowledge that some information on the platform may be confidential, and you agree not to disclose it without Coated Lens' prior written consent. To protect these proprietary rights, you must comply with all requests made by Coated Lens or its licensors. Coated Lens (or its licensors) retains all legal rights to the platform's features and services, including IP rights. You are not permitted to use any Coated Lens trademarks, trade names, or brand features unless explicitly authorized in writing. 
3. Any infringement of Coated Lens' rights will result in legal action to pursue all available remedies under applicable laws. Coated Lens does not guarantee that your use of the platform will not infringe upon third-party rights. If you become aware of any claim that the services infringe upon any intellectual property rights, you agree to notify Coated Lens immediately at info@coatedlens.com or at support@coatedlens.com. 

b. Coated Lens License to Your or User Account 

1. By submitting your portfolio or claiming an existing Coated Lens account, you are granting Coated Lens the right to use your account and all intellectual property rights for any purpose, including API partnerships with third parties and in any media existing now or in the future. 
2. This includes the right to use the name or username you submit. You also waive any claims of moral rights or attribution with respect to your account. 

c. Representations Regarding Your or User Content 

1. You are responsible for your account and portfolio. You confirm that you own all the rights to the works in your portfolio. Your works must not be copied or submitted using automated processes, nor must they violate any laws or guidelines. 
2. You are responsible for all risks associated with the content of your portfolio, including if anyone relies on its quality, accuracy, or reliability, or if you disclose personally identifiable information in your account. Although we have the right to remove content, we do not control the actions or content posted by our users and do not guarantee the accuracy, integrity or quality of any content. You acknowledge and agree that users are solely responsible for the content they post and for any liability arising from it, and not Coated Lens. 

d. Content Removal 

1. We have the right to remove, block, or limit access to any content at any time without prior notice if we find it objectionable, in violation of our terms, or harmful to our services or users. We are not obligated to return any of your content to you under any circumstances unless required by law. 
2. Additionally, The Coated Lens reserves the right to delete any user content at its sole discretion. 

e. Third Party Content and Links 

1. Please note that some of the content available through our services may be from third parties. This includes links to materials such as third-party booking services. Your use of such third-party services will be governed by their terms of service and privacy policy. We do not control or endorse the accuracy, legality, or quality of any third-party content. We do not screen or investigate third-party material before or after including it on our services. 
2. We reserve the right to improve, correct, or change any content accessible on our services. We are not responsible for the availability of external sites or resources and do not endorse any advertising or products from such websites. 
3. Third-party content, including content posted by our users, does not reflect our views or those of our affiliates. We assume no responsibility or liability for any third-party content. 
4. Coated Lens is not liable for any loss or damage you may incur as a result of the availability of external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy, or existence of any advertising or products on such websites or resources. We disclaim any liability for offensive, defamatory, illegal, invasive, unfair, or infringing content provided by third parties. 

VIII. Restrictions on use 

a. Without limiting the generality of these Terms, when using the Coated Lens platform features, you specifically agree not to post or transmit any content or engage in any activity that we, in our sole discretion, deem inappropriate:  

1. Do not post any content that is harmful, threatening, abusive, harassing, tortious, indecent, defamatory, discriminatory, vulgar, profane, obscene, libelous, hateful, or otherwise objectionable.
2. Do not post inauthentic or knowingly erroneous reviews, or content that does not address the services being reviewed.
3. Do not violate any third-party rights, including privacy, publicity, copyright, trademark, patent, trade secret, or any other intellectual property rights.
4. Do not accuse others of illegal activity or describe physical confrontations.
5. Do not post content related to health code violations that require healthcare department reporting.
6. Do not post illegal content or content that violates any federal, state, or local laws or regulations.
7. Do not attempt to impersonate another person or entity.
8. Do not disguise the origin of your content, including submitting content under a false name or pretenses. 
9. Do not engage in deceptive advertisement or cause a conflict of interest.
10. Do not post commercial content, including spam, surveys, contests, pyramid schemes, or other advertising materials.
11. Do not assert or imply that your content is sponsored or endorsed by any entity.
12. Do not post content that is not in English or, in the case of products or services provided in foreign languages, the relevant language for such products or services.
13. Do not falsely state, misrepresent, or conceal your affiliation with another person or entity.
14. Do not access or use another user's account without permission.
15. Do not distribute computer viruses or other harmful code or programs.
16. Do not interfere with or disrupt the functionality of the services or the servers or networks connected to the services.
17. Do not access our proprietary or confidential records without permission.
18. Do not violate any contract, fiduciary relationship, or employment agreement.
19. Do not attempt to derive source code from the services or interfere with security related features.
20. Do not violate any restrictions on access to the services or collect personal information about other users.
21. Do not post content that harms minors or threatens public order or security.
22. Do not modify, copy, or commercialize any rights to the services or our content without permission. 

b. Please be aware that Coated Lens is not obliged to monitor or review user activities on the platform. However, for the purpose of improving services, ensuring compliance with the terms, and abiding by the law, Coated Lens reserves the right to monitor and take necessary actions against any unlawful activities. 

c. Users are expected to use the platform for lawful purposes only and must adhere to relevant laws and regulations. Non-compliant content may be subject to removal, and users found to be in violation may face restricted access and other legal remedies. 

IX. User feedback

1. While sharing your ideas, suggestions, or any documents related to Coated Lens's current business ("Feedback"), you agree that: 

(i) Your feedback does not include the confidential or proprietary information of third parties,

(ii) Coated Lens is not obliged to keep your Feedback confidential and can use it freely,

(iii) Coated Lens may have already received similar Feedback from another user, or it may be under consideration, and

(iv) By providing the Feedback, you grant us a binding, non-exclusive, royalty-free, perpetual, global license to use, modify, develop, publish, distribute, and sublicense the Feedback. You also irrevocably waive any claims against Coated Lens and its users regarding such Feedback. 

1. Only provide specific Feedback on Coated Lens's existing products or marketing strategies. Do not include any ideas that Coated Lens's policy prohibits. Coated Lens and its employees do not accept or consider unsolicited ideas such as new advertising campaigns, promotions, products, technologies, product enhancements, processes, materials, marketing plans, or product names. 
2. Please refrain from submitting any unsolicited ideas or works to Coated Lens or its employees. This policy aims to prevent misunderstandings or disputes if Coated Lens's products or marketing strategies resemble ideas submitted to the company. If you still submit ideas despite our request not to, specific terms shall apply to your submissions. 
3. Terms of Idea Submission
   You agree that: 

• Your submissions and their contents will become the property of Coated Lens without any compensation to you.
• Coated Lens may use or redistribute the submissions and their contents for any purpose and in any way.
• Coated Lens is not obligated to review the submission, and there is no obligation to keep any submissions confidential. 

X. Advertising

1. Some of our services are supported by ads, which may include targeted promotions. The presentation of advertising on our platform is subject to change without prior notice. By using our services, you consent to the placement of such advertisements. Certain sections of the site may contain advertisements or material submitted by third parties.
2. The responsibility for ensuring that submitted advertisements comply with all applicable laws lies with the submitting party. Any business dealings you engage in with advertisers on our platform, other than Coated Lens, are strictly between you and the advertiser. Coated Lens is not liable for any errors, inaccuracies, or losses arising from these dealings or from the presence of advertisements on our platform.  
3. We are committed to working with advertisers who align with our community values and ensure a positive user experience. XI. Additional Terms and Conditions for Users   

• Booking a Professional on Coated Lens
  When using the Coated Lens platform, website, or app, users can request services from creative professionals. A booking is confirmed only after it has been accepted and confirmed by Coated Lens through an in-app notification, email, SMS, or other communication methods. Coated Lens is not responsible for any party failing to show up at the agreed time or venue, or for any losses incurred as a result. 

• Modifications & Cancellations
  Coated Lens serves as a platform to connect creative professionals with clients seeking their services. Any modifications, cancellations, penalties, or charges related to service bookings should be decided between the service provider and the client at the time of finalizing the booking. Coated Lens is not responsible for any disputes arising from changes or cancellations. 

• Personal Information
  To book a service, users must provide certain personal information, such as their name, phone number, and email address. This information will be shared with Coated Lens and relevant service providers, and will be used in accordance with Coated Lens' Privacy Policy. 

• Additional Requests
  Any additional requests made by the user during the booking process will be communicated to Coated Lens and confirmed based on Coated Lens' response. The responsibility for fulfilling the request lies solely with Coated Lens, and Coated Lens is not liable if the request is not honored. 

• Limitation of Liability
  Coated Lens acts solely as a platform connecting users with service providers. It is not responsible for any in-person interactions, user experiences at the venue, or any acts or omissions by the service providers or users. 

• Reporting Concerns
  If you have a dispute or believe that any behavior was illegal under local law, please contact the appropriate authorities directly. Coated Lens encourages users to report such incidents to the relevant authorities.

XII. Disclaimer of Indemnification 

You must compensate, protect, and defend the Coated Lens platforms from any claims, damages, actions, losses, costs, and expenses resulting from or related to:

• Your Content 
• Your unauthorized use of the services, services included or advertised in the services 
• Your access to and use of the services 
• Your violation of any rights of another party 
• Your breach of these Terms, including, but not limited to, any infringement by you of the copyright or intellectual property rights of any third party 
• We have the right to settle any claims without your prior consent, and you agree not to settle any matter without our prior consent. 
• We will make reasonable efforts to inform you of any such claim, action, or proceeding upon becoming aware of it. 

XIII. Termination of your access to the services 

• You can delete your Coated Lens account anytime by contacting us at accounts@coatedlens.com or following the instructions in the "Contact Us" section. 
• Coated Lens also reserves the right to terminate your access without prior notice for reasons such as violating terms or inactivity. Upon termination, your account, information, and access to services may be deactivated or deleted. 
• Coated Lens is not liable for any inconvenience or loss resulting from the termination or suspension of access. If you violate these terms, we may retain data collected from your use of the platform. 

XIV. Community Guidelines 

Our guidelines are designed to ensure that every interaction remains safe, respectful, and positive for all Coated Lens users, including both Service Seekers and Service Providers specializing in Photography, Videography, Cinematography, Editing, Modelling, Motion Graphics, and Design. 

The following guidelines aim to clarify specific behaviors that may result in the loss of access to your Coated Lens account. While unexpected situations may lead to access termination, and these guidelines may be updated regularly, the following guidelines provide ample grounds for Coated Lens to take action. We appreciate your commitment to fostering a welcoming environment. Thank you for taking the time to review them. 

Guidelines for all individuals 

All users who sign up for a Coated Lens account are required to follow the Community Guidelines. These guidelines are based on two main principles and the corresponding standards within each category: 

1. Treat everyone with respect. 
2. Follow the law. 

a. Our platform is very diverse, so you may encounter individuals with differing beliefs or viewpoints. 

b. The guidelines in this section aim to encourage positive interactions in all instances. When using the Coated Lens website or its related apps, treat your fellow users with respect. 

c. Your conduct while using the Coated Lens platforms can significantly influence the safety and comfort of others. Being courteous is crucial.

d. Therefore, you are expected to demonstrate good judgment and behave decently towards others, just as you would in any public setting.

For instance, it is essential to be punctual for your service session, as nobody enjoys waiting. It is also a common courtesy to avoid raising your voice at someone. Most importantly, keep in mind that during a service session, you will meet individuals who may have different appearances or thoughts from your own. It is essential to respect these differences. 

We believe that everyone should feel supported and welcomed, which is why we have established standards regarding physical contact, sexual assault and misconduct, rude behavior, unwanted contact, and discrimination. 

Physical Contact 

Remember to avoid touching strangers or people you have just met when providing your services. It is strictly prohibited to hit, harm, or intend to harm anyone. If a situation requires you to guide customers to a specific position, make sure to obtain their consent before touching them. 

Sexual Assault and Misconduct

We all value our private space and privacy. It is acceptable to engage in conversations with others but refrain from commenting on someone's appearance or inquiring about their relationship status. Engaging in sexual contact or behavior without explicit consent from the other person is prohibited. Do not engage in any form of sexual assault or misconduct. It is important to respect personal space and privacy. The following examples outline inappropriate conduct: 

Behaviors and comments that could make people uncomfortable are not tolerated. This includes nudging, whistling, and winking. Do not touch or flirt with individuals whom you do not know. 

Please keep in mind that seemingly harmless discussions can be hurtful. Refrain from making remarks about someone's looks, assumed gender identity, or sexual orientation. Avoid asking irrelevant personal questions like "Are you dating anyone?" Also, steer clear of conversations about your own or someone else's intimate life, using vulgar language, or making sexual jokes. 

Coated Lens has a strict policy prohibiting all forms of sexual activity. This includes any sexual contact, whether consensual or not, during a session. Prohibited activities include sexual intercourse, solicitation of sexual intercourse, masturbation, and any touching or exposure of sexual body parts. 

Threatening and Rude Behavior

Remember that aggressive, confrontational, and harassing behavior is prohibited. Refrain from using language or gestures that could be seen as disrespectful, threatening, or inappropriate. Steer clear of discussing personal topics that may cause division, such as religion and political beliefs. 

Undesirable Communication 

Contact should conclude once the service you provide or the service you seek is completed. For example, texting, calling, visiting, or attempting to visit someone in person after the service is delivered or has been completed is prohibited. 

Discrimination 

1. We strive to ensure that everyone feels secure and welcome. That's why we have a zero-tolerance policy towards behavior that we have identified as discriminatory. Discriminating against people because of their age, color, disability, gender identity, marital status, national or regional origin, race, religion, sex, or sexual orientation is not allowed by law. 
2. At Coated Lens, we stand firmly against discrimination. For instance, it is not permissible to deny services to someone because of their age, color, disability, gender identity, marital status, national origin, race, religion, sex, sexual orientation, or any other protected characteristic. We are committed to supporting and protecting all our users. 
3. Furthermore, all users must not discriminate based on the customer's, service provider's or service seeker's place of residence. While declining a service booking due to schedule misalignment is within the guidelines, purposely refusing or canceling service bookings or manipulating app functions to evade receiving bookings in order to avoid specific protected characteristics such as age, color, disability, gender identity, marital status, national/regional origin, race, religion, sex, or sexual orientation is not acceptable. 
4. At Coated Lens, we are dedicated to upholding all relevant laws. This dedication is a cornerstone of our operations and a critical factor in building trust. We expect all users of our services to comply with applicable laws and regulations, just as we do. Coated Lens does not claim to act as a legal authority. If you have a dispute with a service seeker, service provider, or customer, or if you believe their conduct breached local laws, please get in touch with the relevant authorities directly. While we value feedback about the parties involved, Coated Lens is not the appropriate platform for reporting illegal activities, physical altercations, or matters under investigation by local governing bodies or law enforcement. We encourage these allegations to be reported to the appropriate authorities. 

XV. Notice of copyright infringement and grievance redressal mechanism 

Coated Lens is not responsible for any copyright infringement resulting from materials posted on or transmitted through the Coated Lens Platform by end users or third parties. We respect the intellectual property rights of others and expect the same from our users. We reserve the right to remove or restrict access to materials that violate copyright laws. We may terminate users' rights to use the services if they repeatedly infringe on others' copyrights. If you believe your copyright has been infringed upon, please follow the procedure below to file a notification: 

1. Clearly state the copyrighted material that has been infringed.
2. Specifically, identify the material on the Services that you believe is infringing on copyrighted material. Provide enough information to locate the alleged infringing material, such as the location of a photo in an album or a listing.
3. Include the statement: "I have a good faith belief that the use of the content on the Coated Lens platform as described above is not authorized by the copyright owner, its agent, or law."
4. Add the statement: "I swear under penalty of perjury that the information in my notice is accurate and I am the copyright owner or I am authorized to act on the copyright owner's behalf."
5. Provide your contact information, including your address, telephone number, and email address (if available).
6. Lastly, include your physical or electronic signature;
